Orders, Payment Processing, and Purchase Terms

Placing an Order

When you place an order on our Website, you offer to purchase goods from EMAAAEST1982 Limited under these terms. All orders are subject to acceptance and availability. We reserve the right to cancel any order at our discretion.

Payment Processing

Payment for goods must be made at the time of order using the available payment methods listed on our Website.

All prices are quoted in GBP (£) and include VAT where applicable. Where VAT is payable, this will be clearly indicated at checkout.

Payment is processed via our secure payment gateway provided by Stripe, and their terms and conditions will also apply to purchases you make via this site.

You confirm all payment details you provide are accurate and that you are authorised to use the chosen payment method.

Order Acceptance and Contract Formation

A contract for the sale of goods is formed only when we confirm your order and dispatch your goods. Until then, orders are non-binding.

In case of pricing or product description errors, we may cancel or correct the order.

Electronic Communications

By placing an order, you consent to receive electronic communications about your order and our products.

Consumer Rights and the Consumer Rights Act 2015

You have a right to a full refund, repair, or replacement if goods are faulty, misdescribed, or not delivered as agreed, under the Consumer Rights Act 2015. If your statutory consumer rights have been breached, please contact us at emma@emaaa.co.uk. These terms do not limit your statutory rights.

Distance Selling and Your Right to Cancel

In compliance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

Right to Cancel

You may cancel your order within 14 days of receiving your goods (“Cancellation Period”), without giving any reason.

To cancel, please contact us at emma@emaaa.co.uk or via our Website, before the end of the Cancellation Period. You can (but don’t have to) use the Model Cancellation Form included at the bottom of this Terms and Conditions section.

Return of Goods

If you cancel, you must return the goods to us within 14 days of cancellation, and you will be refunded for the cost of the item, excluding postage cost.

Goods must be returned in their original condition with all packaging and documentation. You may handle goods only as you would in a physical shop; if goods are returned used or damaged beyond this, we may make a reasonable deduction from your refund.

Refunds

We will refund you within 14 days of receiving the returned goods (or receiving proof of return), using the original payment method. Refunds will include the original standard delivery cost you paid, but not any premium delivery services.

Exclusions

These cancellation rights do not apply to:

  • Perishable items,

  • Custom-made or personalised items,

  • Products that cannot be resold for hygiene reasons once opened (e.g. sealed personal items).

We do not currently sell digital downloads. If this changes, we will update these terms accordingly.

Delivery

We will deliver goods to the address you provide when placing your order. Delivery times are estimates and subject to change due to circumstances beyond our control.

If we cannot deliver your goods within 30 days of your order (or any agreed timeframe), you have the right to cancel the order and receive a full refund.

Risk of loss or damage passes to you when the goods are delivered to the delivery address you provided.

Promotions and Discount Codes

Terms for combining discounts or promotions will be outlined at the time of the offer.

Promotions and discount codes may be changed or withdrawn at any time. We reserve the right to modify, suspend, or discontinue any promotion or discount code without notice.

Third Party Terms and Conditions

Some Website features or services (e.g., payment processors, delivery couriers, external apps) may be governed by additional terms. By using these services, you agree to those third-party terms as well as our own.

What You Cannot Do

You may not use this Website to:

  1. Violate these terms;

  2. Engage in illegal activities;

  3. Harm the Website or disrupt others’ use and enjoyment.

External Content

Links to external websites are provided for convenience; we are not responsible for their content or for any loss or damage arising from their use. If we integrate third-party applications, your use of them may be subject to separate terms.

Disclaimer, Indemnity, and Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses, except where caused by our negligence or wilful misconduct.

  • Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, or liability arising from fraud.

  • Our total liability for any claim related to goods you purchase shall not exceed the price paid for those goods.

Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on our Website (and, where appropriate, by email). The version in force at the time you place your order will apply to that purchase.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Alternative Dispute Resolution

If a dispute arises that we cannot resolve, you may use an independent Alternative Dispute Resolution (ADR) provider. Details are available at https://www.tradingstandards.uk. We are not obliged to use ADR but will consider it in good faith.

Contact Us

If you have any questions about these Terms, please contact us at emma@emaaa.co.uk.

This revised version keeps your structure but adds clarity on refund timing, return postage, delivery risk, exclusions, liability limits, and ADR — making it more robust and compliant with UK consumer law.
